Judge Dismisses Jury In 'Scud Stud' Defamation Trial Over Opening Remarks

    CALGARY — The judge in a defamation trial in Calgary involving a former television war correspondent has dismissed the jury.
     
    The judge said the opening statements by Arthur's Kent's lawyer were prejudicial and it would be unfair to continue after what the jurors heard.
     
    Kent indicated that he would be willing to go ahead with the trial before the judge alone.
     
    Justice Jo'Anne Strekaf made the ruling after lawyers for Postmedia questioned the fairness of the opening statement Monday by Kent's lawyer.
     
    Court was adjourned while Postmedia lawyers talked about the decision.
     
    Kent, who is 61, is suing Postmedia, the National Post and former columnist Don Martin over a column that ran when Kent was campaigning to win a seat in Calgary for the Progressive Conservatives in the 2008 provincial election.
